Thabo Bester and Nandipha Magudumana have lost their bid to stop the Netflix documentary Beauty and the Bester from airing.
Both their legal teams argued that the documentary would irreparably prejudice their upcoming criminal trial, as well as violate their constitutional rights to a fair trial and the presumption of innocence.
But, in the Gauteng High Court in Pretoria on Friday, Judge Sulet Potterill dismissed their bid, saying: “A defamation claim can be instituted and damages sought. I cannot find in any way the screening of the utterances they find to make the doctor guilty affects her right to a fair trial.”
Netflix can now proceed with the broadcast of the controversial true crime documentary, which is scheduled to air on Friday and features former Constitutional Court Justice Edwin Cameron discussing what he calls “the most improbable thing I’ve seen in my life”.
